Hacker Gary McKinnon to be extradited to US within days

Topics: Business ContinuitySelf-confessed hacker Gary McKinnon's final appeal to be tried in Britain was turned down this afternoon. He is expected to be extradited to the US within days, where he faces charges that he was responsible for "the greatest military hack in history".
A statement from Gary McKinnon's lawyers, Kaim Todner, said, "The secretary of state has advised via the Treasury solicitors that despite Mr McKinnon's diagnosis with Asperger's Syndrome [an autistic condition] she will now be making arrangements for his extradition based on her order for extradition of 4 July 2006.
"She has failed to make any request for repatriation to the US when other countries make similar requests on behalf of their citizens."
McKinnon's attorney, Karen Todner, said she has asked Secretary of State Jacqui Smith for permission to seek a judicial review of the decision to extradite McKinnon. Smith will give her decision tomorrow morning.
If granted, McKinnon will have 14 days to apply for the review, which will be held by the High Court. If he decides not to ask for the review he will have 10 days to prepare himself for extradition.
Todner described McKinnon as "devastated". "He has been suffering from depression for several months now," she said.
She added she was "optimistic" that Smith would grant permission for the judicial review.
McKinnon has failed in his appeal against extradition in every available court in the UK and Europe.
A judicial review would delay things until after the US Presidential election, which may very well suit the unpopular Labour government.

If a judicial review is granted and things are delayed until after the US election, I can't help thinking that Obama may well feel that the embarrassment that this case would bring to the US military is just not worth the bother.

It is now time for someone to take courage and step out of the shadows, a "whistleblower", to tell people, without threatening any National Security, or giving away truly sensitive information, what they know, and, to the point, what they think this is really all about, for every sane thinking person who has followed this case knows in their hearts that there is certainly another, unexplained agenda going on here. I learned only last night of the case of an Australian citizen who expressed an opinion, on the internet, that the Holocaust was reported wrongly historically and that 12 million other people, gypsies, Christians, etc., also died in that black travesty. An arrest warrant was put out for him by the German Government. This guy was on his way to the U.S. as a tourist and was arrested in transit at London's Heathrow airport by the British Government who then handed over to Germany where he is now serving a prison sentence for ostensibly "invading German airspace on the internet". Another guy, a Canadian, who married an American and was awaiting naturalisation in the U.S. was arrested by the Canadian Government and handed over to Germany on much the same ticket. Hatemongers on the web or anywhere else should never be tolerated, ever. But is freedom on the internet, even spouting ridiculous personal views, being curtailed? I throw this in for the conspiracy theorists. But what is happening to Gary McKinnon is no theory. Also, it was reported briefly, before it disappeared from AOL, that the British Government had frozen and seized the Icelantic banks financial assets under "anti-terrorist" legislation"! There is a kind of hysteria in the air. Certainly not, in this area of subject, "a kind of magic". It goes without saying you guys are never far from my thoughts. What the hell is going on? Someone, somewhere, knows. The crash you heard is me falling from my soapbox for a second time. You lose your balance when you're constantly scratching your head. Every man, woman and child on this planet is all in this together. No exceptions. None.

This extradition is unfair unjust and Gary should be given a fair trial here in the UK. Extradition without evidence or a chance of a fair trial is wrong. The extradition state is Virginia and any jury would be made up of more than 50% Government and armed forces as West Virginia has the largest amount of Government and armed forces personnel in the US. and other co-morbid conditions. So he should be tried on home soil and

I'm glad to read that Gary is still fighting the extradition. The US government has the power to make any deal it wants with him and they'll probably offer him a very lenient sentence for pleading guilty to just a few or even only one charge.
On the other hand, Gary is doing the right thing for his own benefit by resisting US government pressure. I have always believed and still believe that if he goes to trial in the US, his defense attorneys will greatly embarrass the US government and thereby reveal a lot of classified information that will benefit civilization as well as create a demand among Americans for a reform of their secret government.
It's a tough call Gary, but what ever you decide, you're the one on the ground and you can't be second guessed.

The US and British Governments are corrupt and this situation about gary mckinnon is a good example of Corporate corruption, they are embarrassed by this guy because of a lack of security on their part, all i can do is suggest learning more about the laws in this corrupt world of ours, try finding out more about Jordan maxwell, he knows more about the corruption in the system of so-called law, and gary will never be given a fair trial in US, there is no such thing as a fair trial in a system of corruption. he's not even being given a fair trial in UK never mind the US. the US government is a private corporation of the British monarchy. as a natural person gary does not have to comply with any requests by any corporation. look into it and learn. hope all goes well.

Apparently any U.K citizen can take a prosecution out against Gary for computer misuse and that would result in forcing the CPS to prosecute Gary and for a trial to take place in the U.K which is what Gary would like.
If anyone feels they would be able to do this as it's probably a lot of work, I'll pass on details of a Barrister that will help to advise.

Gary will be picked up by the police he won’t even be able to take a photograph or wedding ring with him. Then somewhere between the prison and the airport Gary will be handed over to 2 US Marshals one handcuffed on each side and both will be armed. He will be heading for a US state with no chance of a fair trial as the State of West Virginia will have more than 50% of its jury Military and Government employees that will make up the jury. I have ben in touch with Shami Charabarti's, Liberty offie this afternoon, after hearing this terrible news from Nadine.
Nadine was going to speak with Liberty lso Nadine is speaking Paul Shattock to put Gary legal team in touch with Jeff Sell, 'specialist' lawyer in the USA on these type of cases.
I am waiting to hear from Nadine of the outcme of the aqbove. It's 5.32pm in the UK now.

I have asked Nadine for Gary's solictors to take Gary's case, under the UN Disability Convention, especially has I have previously stated, that with the UK, being part of the EU and the EU Parliament have signed and ratified the UN Disability Treaty and the extra Protocol too, so Gary could take his case against the UK to the UN, as a EU citizen, wherea also his solicitors could bring a case, against both the UK,USA and the European Court Of Human Rights to the UN Disability Convention, especially also other the Extra Protocol, as a EU 'citizen'.

By law with Gay now being diagnosed with a learning disability Gary has to be represented by a barrister as a vulnerable person.
Nadine has had no luck with getting hold of Jeff Sell, through Paul Shattock.

Dear Jacqui Smith, Home Secretary,
As you can see below I have made complaints about disabilist comments, attitudes and behaviour aimed towards me as an Autistic, Neuro-Diverse professional, user lead advisor, educator and consultant in the field of Autism, Neuro-Diversity and mental health to various government departments and the UN disability convention that sadly again, in my contact and correspondence with the Home Office I have been subjected to disabilism again.
As an active member of the Human Rights and Civil Liberties movements especially in my field of interest, Autism and Co-Morbid and associated conditions (as mentioned above) again I need to bring to your attention, not for the first time in my work that reasonable adjustments as per my requested access needs were not met by the Home Office which is totally against your disability equality duty.
I am duly informed and have experienced in my research that out of all the government departments the Home Office is the worst, not just for people living with autism/neuro-diversity and mental health issues but for the wider disabled community.
In my work I have been liaising on basic human rights issues and civil liberties with Shami Chakrabarti and others at Liberty and like many more individuals within the autistic/neuro-diversity rights movements and wider mental health and disability rights movement are pro actively campaigning within the Garry Mackinnon case.
All I tried to do this morning was to ring your office to ask some questions to you as the minister about this case. At the present time, I am not typing this letter, it is being dictated to my PA/support worker. This is not her job, it is the duty of all service providers and statutory bodies under the DDA 2005 to accommodate the needs of all disabled people.
This morning, my needs were ridiculed and I was forced to make my own written notes which caused me a great deal of physical pain, distress and discomfort. This complaint has been made to the Equality and Human Rights Commission and Liberty.
The EHRC and Liberty are well informed that I am an autistic/neuro-diverse person without any assistance, support and technology aids and equipment, which I am fighting for. This is why I asked for assistance this morning, I don't have the technological aids I require so have to ask for the support of staff and officers. This clearly shows your lack of understanding of the needs of Autistic individuals and it is no wonder you do not understand Garry's needs.
I would like some conciliation/mediation under the DDA 2005, I am happy for this to be facilitated by Liberty and the EHRC.
The EHRC, Liberty and others are well aware of the autistic rights movement anxieties and concerns around Gary’s case, not just for autistic people but ALL disabled people, especially those with neurological differences, developmental disorders, learning disabilities, specific learning disabilities, and those living with mental ill health/distress are all at risk.
This has been brought to the attention of the EHRC and the government as a basic human rights and civil liberties issue which has a strong public interest. Liberty have taken on my concerns and that of the autistic/neuro-diversity movement and the wider disability movement.
Liberty have expressed their concerns and we all feel that this is a one way treaty which is in breach of the UN convention. Are you aware that Gary, as an EU citizen could take this to the UN disability convention as it has been ratified by the EU?
I would like some of my questions answering about this case;
Has a disability equality impact assessment been done on the Gary Mackinnon case?
Has Mr Mackinnon been represented throughout due process by a specialist barrister who has expertise within the field of autistic spectrum conditions/neuro-diversity and co-morbid conditions.
In the UK Gary is defined a disabled person with a learning disability and mental health problem, in the USA Asperger Syndrome is defined as a pervasive developmental disorder which is not used in the UK or the EU community so which medical/clinical definition will be used in Gary's case?
Has this case been brought to the attention of Her Majesty the Queen for the consideration for a royal pardon?
Gary is not a bad person, he is a disabled person who’s behaviour was fuelled by fear and anxiety. He is not a terrorist and the way he is being treated like one is deeply effecting him and his family as well as other disabled people.
Please note that if he was a terrorist I would be backing your decision 100%. No-one in the Home Office understands that Gary’s behaviour has been fuelled by anxiety, as he was left undiagnosed for so long his anxiety would have been out of control.
He is in his current position because there has been a serious failure to discharge a duty of care by the UK state.
He should have been diagnosed a long time ago, this is clear negligence. It appears that you are now questioning the legitimacy of his diagnosis, he has been assessed by two leading experts in the field who are willing to testify in court.
case is causing me a great deal of anxiety and distress.
I feel threatened by this and need some reassurance from you.
Can you empathise with my severe anxieties on this?
This is why I am asking if you have done a disability impact assessment.

Here is a copy of the notes that I have forwarded to Reni Parekh and Neil Crowther as requested, and also my team leader. Caller has an issue with Home Office. He is involved with the Gary MacKinnen case. He has great concern about this, and he attempted to speak to someone within Jackie Smith's office within the Home office. Caller explained that he has autism and asked for reasonable adjustments as he has problems with writing things down. The person who answered the phone at Jackie Smith's office laughed at him and refused to give caller his name. He also made discriminatory comments and antagonised caller - he wouldn't listen when caller explained that he appeared to be shouting as he has autism. He also wouldn't email information to caller. He also refused to put caller through to his line manager, or the data protection officer to request a recording of the conversation. This happened this morning, so caller called helpline immediately. He is very distressed about this issue, and called the helpline as he could not get through to Neil Crowther or Reni Parekh.

It seems that the Home Office do not understand Autism and neurological disabilities at all - no wonder they completely dismissed Gary's difficulties and ignored his rights.
Gary is a man with a disability, NOT A TERRORIST!
He's made a mistake - so let him make it up to you by employing him to work for the British government to systemise, organise and improve the security systems. So you won't have any more lost data and other incompetency on a job.
Let him work and pay taxes. The level of unemployment is rising - I bet majority of the people on the doll are autistic on some level.

All Gary wants is to be allowed to stay in his own country and not to be torn from the land he was born in.
Extradition was intended to bring fugitives back to the country they had run away from after commiting a serious crime, usually back to their own country.
It was not intended to be used to tear a citizen from their own country to take them to one that is alien to them and to which they have never even visited.
If someone has committed murder then that's a different story but the American government is now snatching people from the U.K because, for example: they have legally sold chemicals online, or sold electrical components online or because they have legally had online gambling.
These are not crimes in the U.K so why is our government allowing our citizens to be kidnapped by America.

23 yr old US citizen with deep sympathy for this man. This government will do whatever it takes to keep people quiet. What's so sad about this is that I was doing similar things back when I was only 15 and 16 years old. I was just going into personal home computers and messing around with people for kicks with ispy when that was popular, but never imagined one could so easily infiltrate the government. When the election is over, hopefully Obama will appoint some people that aren't far-right conservative computer illiterate twits into office. Maybe he can then make a plea that will actually be heard.

I agree that many American people are Wondeful people with a great deal of compassion and many of them suuport Gary but the current American administration is far from Wonderful and to be tried in Virginia where most of the Pentagon employees reside would be the worst thing that could happen and that's the plan.
Only 96% of cases in the U.S ever come to trial and the rest are plea bargains. Many innocent people agree to plead guilty even to extremely serious crimes, in order to eventually gain their freedom and that is not a Just system.
Many of the sentences in America are totally outrageous and often totally diproportionate to the crime and that's a real problem.
I do always try and remind people that it's not the American people they should be angry at, but the current American administration.

The Pentagon is supposed to have several joint secret underground bases with extraterrestrials; also on the moon. The extraterrestrials are at least 1,000 years more advanced than us - remember, they came here, we didn't go there.
So, whom do you think is fooling who? Some of what this means is that if Gary saw real UFO pictures in the Pentagon and other such information, the Grays wanted those to be seen.
Gary's best chance is to continue keeping his head above water and not give up on life - the big picture. So, he's in charge of his destiny and whatever decisions he makes we must give him our unconditional support.

As Adrian and I have pointed out to Jacque Smith, that the 'prima-facie' that should be the lead argument within this case, is that how can Gary have committed any 'alledged-crime', under this 'Treaty', when the 'Treaty' was not in place at the time when Gary commited this alledged crime, so within British/EU law, then 'retrospective-treaties' betwwen the USA and UK can not be used, so there is no case to answer. Case closed 'Your Honour' on a maladmistration error within law.

Happy to vote them out once we know that the next government will abolish the present Extradition treaty and so far no one has said they will; in fact some even want to abolish Human Rights in the UK.
Lots of Tories were extremely against the extradition treaty with America but when it came to a vote that counted, only a few actually voted and many of Labour abstained. Now what sort of a democracy is that?
The Liberal leader I liked until he ordered his party to vote not to vote against him. What is democracy if not to have the courage to express different opinions and have the freedom to vote with your conscience.

If Conservative had brought in the amount of surveillance and bad extradition laws as the Labour government have, their would have been riots on the streets.

The legal team have worked really hard and they're honest to the core.
Gary's solicitor, Barrister and QC had the guts to stand up to the American prosecutors and told that in secret meetings prosecutors said the "Like to see him Fry comment" and that the prosecutors said they'd refuse repatriation and prosecute Gary to the Max if Gary didn't accept the so called plea bargain offered.
People have to remember that any proposed sentence was x7 as Gary has seven counts against him.
So when they say a 5year sentence was offered, think 35 years.
Very few solicitors would personally offer themselves as witnesses against American Ex CIA witnesses and Gary's team did.
There is no case for the lawyers to fight as with the new extradition treaty with America, U.K citizens can only fight the extradition on Human Rights issues as they're not allowed to fight the actual case and Gary's legal team have worked hard on the Human Rights Issues.
Allegations by the U.S prosecutors are dishonestly presented as "facts" and are accepted as "facts" by our judiciary.
We are now Judged guilty before we have a trial.
Our Crown Prosecution Service are told to stand down in certain cases that the Americans want to prosecute and when they want to extradite U.K citizens to do this.

This US policy may be the reason extradition is always given to the US from the UK.
In United States v. Alvarez-Machain, 504 U.S. 655 (1992), the Supreme Court ruled that a court has jurisdiction to try a criminal defendant even if the defendant was abducted from a foreign country against his or her will by United States agents.
Though this decision reaffirmed the long-standing proposition that personal jurisdiction is not affected by claims of abuse in the process by which the defendant is brought before the court, it sparked concerns about potential abuse of foreign sovereignty and territorial integrity.
Due to the sensitivity of abducting defendants from a foreign country, prosecutors may not take steps to secure custody over persons outside the United States (by government agents or the use of private persons, like bounty hunters or private investigators) by means of Alvarez-Machain type renditions without advance approval by the Department of Justice.
Prosecutors must notify the Office of International Affairs before they undertake any such operation.
If a prosecutor anticipates the return of a defendant, with the cooperation of the sending State and by a means other than an Alvarez-Machain type rendition, and that the defendant may claim that his return was illegal, the prosecutor should consult with OIA before such return. See Criminal Resource Manual at 610, for further discussion of the law on this issue.

From Justice Frank Iacobucci's report, we learn that the Canadian government was responsible for the torture of three of its own citizens, but only "indirectly." Phew. Isn't that a relief? Sarcasm apart, this new report just confirms what the Maher Arar case had already demonstrated. After 9/11 our security forces toadied to the United States government, feeding it with inaccurate information and turning a blind eye to its completely illegal practices of rendition and torture.
These were shameful actions done in our name. We can only hope that they do not continue.

Extradition involves four basic steps:

Some courts have held that the Speedy Trial Clause of the Sixth Amendment or the Speedy Trial Act require the

What went wrong here is that they new of Gary in 2002 and that was when extradition should have begun. As you can see from the above US LAW they waited until the UK intruduced the 2003 extradition act in January 2004 and then Illegally set out on a questionable extradition.

Firstly he did not "Steal" information. This is an example of judging someone guilty before he's even had a trial.
There has been no trial as Gary McKinnon is not allowed to contest the allegations made by the American government but if we want to extradite an American we need to provide actual evidence. Now how one sided is that?
Gary can easily be tried in the U.K and not sent to the U.S to face a ludicrously long sentence for what was a low level computer crime that would attract six months community service in the U.K

Somebody not so long ago suggested that Gary should flee to Russia in order to avoid extradition to my country, that tortures foreigners and can legally torture me if Emperor Bush gives anyone the authority to declare particular U.S. citizens to be Unlawful Enemy Combatants. Here in America, in big cities like London, there's lots of Gutter Punk Kids, who if they would see someone heroic like you lieing down in the street outside of Gary's flat, will join you, even if they don't know what's going on, or even up from down (there's a very big problem here with meth and heroin). But you must take the initiative. Also, the British are famous for joining queues even when they don't know why people are lining up. A horizontal queue shouldn't be that difficult. It's up to you.

I find current British T.V. and movies quite refreshing. People of colour are portrayed in an ordinary manner just as are people who lack colour. I can always tell a modern British show because of its respect for everyone.
Yesterday, Mr. Arnold Schwartzenegger, the Governor of the State of California, made fun of U.S. Senator Obama's physique. His criticism is in character given his use of the phrase "girlie men." But, more than that, about a year ago after I bought and watched several times, his movie, "Terminator II," I came to the conclusion that the African American scientist, who had a wife and kid in the movie, who were in essence saved by the Terminator, was not portrayed fairly. In fact, the other kid, who the Terminator was protecting is shown in a more adult fashion than the African American scientist.
Although Arnold did a good thing by leaving then Socialist Europe, he's acculturated to America a wee bit too much.
Finally, there's a member of the British peerage, I think her name is Redgrave, who welcomed home some British citizens who had been tortured by the American and later released from illegally (according to International Law and U.S. law) American-occupied Cuban soil - Guantanamo. Does anyone know if she has an opinion about Gary's plight?
