European Court of Human Rights refuses request for interim measures by Gary McKinnon
On 29 July 2008, Gary McKinnon lodged an application with the European Court of Human Rights (application no. 36004/08). He complains principally under Article 3 of the European Convention on Human Rights (prohibition of inhuman or degrading treatment) about the conditions of detention he would face if convicted in the United States of America.
The Government of the United States have sought his extradition from the United Kingdom to stand trial on charges of fraud-related activity in connection with computers. He is alleged to have gained unauthorised access to military computers in the United States from his home in the United Kingdom.
Mr McKinnon sought interim measures under Rule 39 of the Rules of Court to prevent his extradition to the United States while the Court considered his application.
On 12 August 2008 the Acting President of the Chamber to which the case has been allocated decided to indicate to the Government of the United Kingdom, under Rule 39 of the Rules of Court, that the applicant should not be extradited to the United States before midnight on 29 August 2008. This was in order to allow the Chamber to examine the request at the earliest opportunity, namely at its meeting on 28 August 2008.
On 28 August 2008, the Chamber decided to refuse the applicant's request for interim measures.
Mr McKinnon has therefore been informed that the Court will not prevent his extradition to the United States.
Under Rule 39 of the Rules of Court the Court may indicate to the parties any interim measure which it considers should be adopted in the interests of the parties or of the proper conduct of the proceedings before it.

Ever present in our system of justice is the political establishment. There is no separation of powers in our constitution demonstrated here; only the ownership of a huge tract of our legal system in the hands of the UK and, as a result, the United States Governments. These decisions were not made on a point of law; they were made to produce a stark political statement.
Neither the ownership of the legal system nor the ownership of the British Government resides in our hands anymore, if it ever did. This latest move is a deliberate act by the British Government to show they, in tandem with a global elite, make the decisions now. Our values and our rights that we, the true British people, have built up over a thousand generations have been evicted by the seizure of control by a powerful minority.
This powerful minority has signed over our liberty to the United States Government not through cowardice but as a further measure to maintain their own status. It reflects starkly the Roman invasion of Britain, where the Celtic Kings rolled over for wealth, villas and fine wines with no regard for their own people. Also, like them, eventually the invading power will take more and more control over our lives.
Gary McKinnon's case is the tip of the iceberg; we all sucombe to the United States now. Our passports are to be microchipped, ID cards will be pushed through one way or another and it is only a matter of time before detractors are at best shunned from society and at worst imprisoned. Gary McKinnon of course is not a target because of hacking a few computers, he's a target because he had the nerve to access, albeit so slightly, information regarding the Government of the people.
The US action has been taken because they very clearly believe ordinary people should have no access or interest in their own Government. They want to shut us out and if they can't they'll come down on detractors like a tonne of bricks. And they want Gary so they can silence him in prison from what he saw (although I don't believe he saw anything 'alien') and so eventually they can shut him up once and for all. Just like they killed Milosevic once they realised he could incriminate them more than they could incriminate him.
We need to use the McKinnon case to begin a wider political movement to remove global elites from power. Just for the record, I'm not talking about wacky theories of reptilian leaders and I'm not going to start citing David Icke!
I'm talking about how globalisation has increasingly placed power in a few rich hands; how the media collude with politicians to build a public response and how too much goes on behind closed doors. From Jimmy Carter's Trilateral Commission to David Davis' support in his by-election by prominent members of the Henry Jackson society (who advocate pre-emptive strikes, ID cards and all the other terror babble) something's rotten in this world.
The charade of a politically controlled court battle is over. Now the fight needs to be taken to world Governments. Make it politically expensive for a political party in the UK to support his imprisonment by pushing the liberty and democracy message; demand changes in our extradition laws. Heck, why not encourage people living in countries outside of the extradition treaty to read NASA's real e-mails about things like their Christmas party plans and how another Mars mission has been a failure.
Ultimately, we need to just dissent against this global power. Every time they want to do something, stand in their way. Bring this charade to a halt once and for all.

If anyone should go to court about the hacking incident it is the pathetic IT companies who sold such pathetically insecure software to such security sensitive installations. Gary McKinnon deserves a medal for exposing how vulnerable our defence IT systems were. He is scape goat and is being abandoned by the pathetic jobs-worths that are our New Labour government, who would trade any rights we may have for their party positions and to appease our more powerful "ally". How can a treaty be enforced on one side of the atlantic only? Where is the natural justice in this? An absolutely shameful affair, shameful. I've written to absolutely everyone I can think of about this. It only shows how supine our "protectors" and "guardians" are - we have no rights at all.

A first year law student could point out the judiciary are acting under duress, because they've ignored two pretty basic principles of English and European law.
Take the Human Rights Act 1998, which puts on the statute book the European Convention on Human Rights. Article 7 concerns retrospectivity. In layman's terms, that means no punishment without law. If the law and penalties do not exist at the time of the offence, you should not have to face them.
Even though it does provide a caveat for international law breaking, we all know Gary McKinnon was not committing a domestic criminal act against the USA (because he was commiting the offence in another country and another jurisdiction, and it wasn't treason) or breaking international law.
Gary McKinnon committed an illegal act in the UK and understood the penalty to be the same as Mr. Bevan who did the same in the 1990s. He could not reasonably expect to face a US penalty because he had no reason to believe he was breaking anything other than a UK law. The treaty which allows his extradition with no evidence whatsoever also did not come into force until after his last offence. He could not expect this penalty in law; thus the ECHR has now committed an illegal act by allowing his extradition.
There's all sorts of reasons why the treaty is a pile of utter crap as well. It wasn't introduced in Parliament, it was introduced with the Royal Perogative (maybe the Queen would like to pardon Gary from this treaty as he's meant to be one of her subjects and this is a matter of prestige). The treaty isn't retrospective either. It's a nonsense and I hope we'll all be writing several thousand letters to MPs demanding to tear up this abysmal treaty.

I am so sorry that we live in such a corrupt world. Sometimes I wonder if even a revolution would do it. Make things on this planet right again. Or maybe the evil that has overtaken us is not stopable, maybe its time to turn the planet inside out and start over. Somewhere we made some critical mistakes and what we have today is a planet that kisses the ass of the almightly dollar and nothing else matters.
Sometimes I think that there is a glimmer of hope. I have really tried, myself, to increase awareness by doing lots of activism in the past. It only had a small effect on the general population and resulted in my persecution.
On a day like today I feel that there is no hope for planet earth. 26 is sad.

Incidentally, Andrew, if you wish to display your astounding ignorance of the criminal law, I suggest you write to the Sun. If you actually bothered reading any of the judgements instead of assuming that you know what is being said, you will see that it is clear that what Mr.McKinnon did was a crime on both sides of the Atlantic at the time he committed the offence. As you have demonstrated, ignorance is no defence and the fact that he did not expect to be extradicted makes no difference to the fact that he could be under the law as it was at the time.

The ruling today is unfortunate, and continues to raise questions on the nature of our bi-lateral extradition agreement with the USA. But, at the centre is the fact that McKinnon did break the law.
Personally I feel that the punishments mentioned are excessive, but there is no benefit in commentators claiming "this to be a zionist conspirary", or "he is a genious [sic".

It was originally sent to the Senate for ratification in 2004 and ratified in late September 2006. Pretty fast work for the Senate.
And if he is successfully convicted, he's looking at 3-5, not 60-70 years. For some reason, the British media has chosen not to report this even though it came from New Jersey prosecutor who originally filed the charges.

we should initial a meetup group and protest this travesty in front of the houses of parliament. gary's intentions were not of a malicious nature. To me Gary is a robin hood of the 21st century who got caught and is being made a an example off! It wasn't just about ufos but more important subjects such as free energy technology's that he was in search off. He did this out of his interest to help mankind and not for his own self gain.

Hacking and viruses cost people much misery and financial loss.
Whether he did this as a joke (to prove he can hack the system), as a quest to find the truth about UFOs, or as an extremist angry at the USA, he deserves serious punishment for this crime. 60 years is excessive but a good 5 years in the slammer is justifiable.

To Dean Mance.. Wonderfully enlightened view you have there.. I don't recall any mention of destruction or viruses in regards to Gary, so how is it related to your own issues with wasted time and money? (If the US had invested a small fraction of their significant revenue into decent security in the first place then surely Gary wouldn't have had the opportunity to look for UFO information on their systems?)
Irregardless, this isn't an issue about whether hacking or viruses are right or wrong, it's an issue about whether British citizens should be packed off to the states at the whim of the Federal government.. My passport says 'afford the bearer such assistance and protection as may be necessary' on it.. As a British citizen I think Gary should be afforded that same protection, as guaranteed by Her Majesty.

It's still amazing of how much destruction one man and his computer can do according to the media. We all know that these numbers were blew out of portion and if anything the most Gary should have to do is pay for the "Experts (pfft)" to re address the U.S. military computers and patch up any security flaws that might exist.
I feel this was helpful to the United States by identifying a problem that needed to be fixed. You would think if Gary could had informed the government that this security issue existed that they would have supported him and cherished his work. However this is not the case and I personally would not have notified the government myself if this were me due to the fact that even then they want to dig a hole for you like your not even a human being. Gary is a young guy from what I can tell. He still has a lot of his life to live. He could have murdered someone and got a lesser sentence.
I had a cousin who was 6 years old murdered by his step-mom in which she strangled him after picking him up from school and burnt his body throwing him in a hole and covering it up. She was sentenced 7 years in jail. Gary gets 60-70 ?
The people who believe that Gary's sentence is fair are immoral and unethical. You apparently have no idea of the whole situation or knowledge of computer systems. Even if data was erased by Gary as we all know the data would still be on the hard disk. I doubt he did a secure erase or was so destructive and acting as terroristic as the U.S. seems to portray.

I found in today’s Metro (29/08/2008) newspaper what the verdict is and I’m in BIG shock! How people can be so stupid to involved in nonsense allegations like: “terrorism, intimidation and coercion for US gov, etc” for man who is amazing skilled and have a live passion. The man who’s knowledge never was used for terror or other bulshits, just used to show weakness and unprofessionalism for other people and agencies.
I’m Polish who live in UK 3 years and IT person as well. I just can’t believe that UK gov can be so easy manipulated by US-Bush-CLAN. UK will lose so big talent. For me this case is just another argument that US try to hide some evidence that they are in contact with aliens! @ Dave T. The judgements are irrelevant. The crime was committed on British soil and was therefore a British crime (not a US one) when he committed it. I somewhat doubt we would send someone to China or Burma for hacking into their network, so why we're doing it in this case should baffle anyone with a grasp of conflict of laws.
From reading your post I get the impression you're the type who thinks justice is only the right of someone who can afford it (as you indicate no willingness to use taxpayers' money to defend themselves in an unnecessarily expensive system) and also the type who likes to 'bend over' for the USA.
You're welcome to sell your British liberty for a fistful of American dollars. Personally, many of us have far too much pride and far too much to fight for.

Yes Kevin, the senate ratified what you linked to, because the effect of that ratification was (quoted from your link, my caps):
"The treaty, first sent to the Senate for approval in April 2004, lowers THE LEVEL OF PROOF THE U.S MUST SHOW to win extradition of a suspect."
The is no reciprocal lowering of proof on the part of the U.K. when seeking to extradite U.S. citizens, like if they illegally killed some British journalists or bombed British soldiers without following procedure, to take two entirely random examples.
Thats why this treaty is grossly unfair and essentially the giving up of sovereignty to a bullying nation who likes threatening its friends.

has assessed that there is a prima facea case to answer, otherwise we
are all hostages to fortune.

I have been unfortunate enough to experience 30 days in a US jail because of drinking and driving 12 years ago. It's very rough in there with heavy handed, abusive guards and inmates.
What really frustrates me is the fact that in the 80s, Markus Hess, hired by the KGB to hack into US DOD systems, was eventually caught, tried in Germany and sentenced to 1 - 3 years in Jail, released early.
Doesnt make any sense.

You have to wonder where this will stop. When has a foreign jurisdiction ever been able to impose its law on someone who has never set foot in their country?
In theory, (based on this case) the USA could pass a law demanding all world citizens swear a pledge of allegiance to Old Glory on pain of life imprisonment. They could then pluck citizens out of every country it has a treaty with who refuse to adhere to its law. After all, this case effectively says it doesn't matter where in the world you are or what state's laws you're meant to follow, if a foreign nation decides to criminalise something world wide it can enforce its law.
Oh, and in the USA, they won't need to provide evidence to Britain first before seizing its citizens either because of the Treaty.
That is the precedent this case has set and I for one am prepared to do literally ANYTHING to overturn it. Take that as a warning, NuLabour.

This is just to show my general support for Gary McKinnon, and to state my anger at our government over this extradition. I feel that this case represents a gross misunderstanding of the nature of McKinnons actions, and the faith in which he acted by revealing his actions to the American authorities and to others.
I would like also to note that the American authorities have stated that Mckinnon's actions "will be treated under anti-terrorist law" if he does not co-operate (whatever this means). I am shocked that a "democratic" government feels they can divide their supporters (co-operators) from their detractors (non-co-operators) in this way and asign each group to a different legal procedure.
Furthermore I would like to state my fear that extradition for an offence perpetrated via the internet is a teriffying precedent. It demonstrates a de-facto situation in which individuals are no longer protected by their sovereign elected body (the state), but are instead subjected to laws made by foreign governments in which they have no stake or representation.
This act by our government demonstrates a complete subjection of individual life and liberty to the causes of international trade relationships. There is no excuse for this and Mckinnon has my full support.

Dave has a very good point actually. Gary could try 'doing a Pinochet' (we like protecting Chilean dictators, it's ordinary British blokes the Government don't seem to care about) and claim a reason he can't travel.
I also quite like the idea that we all handcuff ourselves to him. I'd definitely be up for that.
Alternatively we could abduct him to a democratic country like Venezuela for safety, although the logistics might be difficult. Still, considering we'll only be up against a military too stupid to think of a password, it could be done.

Have you recieved all my emails from all my colleagues and myself from within the UK and global Autism, NeuroDiversity and Disability movements, including UN Disability Convention on this case?
There is advice on what to do urgently now. This advice is for Gray's legal team and as mentioned within the emails contact details of a 'soecilist 'Autism'legal advocate who deals with these sort of human rights civil liberities cases on behalf of Autistic people like Gary.
This solictor, as Paul Shattock, stated with his email deals with 'Autism and Hacking' cases.
There other cases like this which involves Autistic/NeuroDiverse disabled with untreated obsessive behaviour like Gary.
Gary has only just recieved a late-diagnosisa of Asperger Syndrome; and as I state in my emails this should be used at the 'fore-front' of any appeals process and 'counter-claims'for failure/late diagnoses and appropraite treatments/therapies. This is a failure of dutry of care ande negligence by 'The-State' (UK) in Gary's case.
Also, as I advised within my email Gary has also got a case against the USA/UK and European Courts of Human Rights, under the UN Disability Convention, which came into legal effect on 3rd May 08 and Gary's case could be taken to the Un Disability Convention Select-Committee on disability discrimination and basic human rights abuses aaginst a vunerable autistic/neurodiverse disabled person.
There are many of us within the UN Disability Convention and wider Disability movements keeping a close eye on this case with great inerests and sadness and empathy for Gary and his family, friends and all his allies and supporters.

Gary, one of most worthwhile and courageous guys around is George Galloway. He's a highly intelligent fair-minded fighter and a fellow Scot. He has been running an excellent "phone-in" show on a station called TalkSport besides actually being an MP. I took the liberty of e-mailing him last night, and, to his great credit, he e-mailed back within five minutes saying he was on your side and would never abandon you. This is an understandably shattering time for you and yours. However, may I seriously suggest you consider appearing on George's show to further highlight all this on his platform. You will not have a better ally. Other than that, sure, we can all e-mail or write to our MP's, but in all truth they are part of the problem. The public need to mobilise the media themselves. Other than that, Stay Sunny!

The ability for a civilisation to strive comes down to there access to resources and energy.
If you can control the energy then you can ultimately control the people and hence get more control of the resources. This seems to have been going on from before I was born and is no so rooted in society that is will be very difficult, if not impossible to stop - unless more people like Gary can open our eyes to the truth.

I am thinking that this has maybe gone far enough in the legal sense. And to all persond involved the "legal process" has failed to protect and uphold Gary's legal rights to the greatest extent.
Maybe it is time to think about passive civil disobedience. The law regarding extradition and computer crime is a fairly new area of law in its evolutionary stages. There is a lot of grey areas that have not been clearly defined and such, the entire case is completely bias and unfair.
I would say if necesary, do not make yourself available for extradition.

I am Russian citizen, my name is Tatyana Guseva and I would love to leave my personal comment here on the Gary's page, and give my emotional support to Gary. I wish his family to stay strong and believe in good outcome of the case. I have read all the info on the page and I was feeling how my heart painfully sank. I can imagine what Gary's family feels. In October 2006 I have been arrested by Scotland Yard at my house in Manchester and accused for International Child Abduction. The point is that I have been married to American and we prepared stipulation for custody of our child where we both agreed that we separate or no longer reside together, I shall have primary physical custody of our child, regardless of whether I reside in the USA or return to Russia. My ex-husband agreed then that he will not seek primary physical custody of the child. The stipulation was signed in presence of solicitor. However he applied for sole custody during divorce proceeding. Supreme Court denied his request. Later he applied to Family Court for sole custody once more and I got information that he is going to win the case. Well, I decided to leave the US asap with my daughter. I applied for the UK visa and soon I have been granted a stay status in the UK. I have got a job, my child got place in primary school, but while before starting the school she was visiting my sister in Russia, I have been arrested for International Child Abduction in accordance with Hague Convention and imprisoned for Extradition proceedigs to the USA. Next day I have been granted a bail condition. I was going through a lot of court hearings without any results. The Extradition proceeding was adjourned because the UK authorities tried to find a way how to get my daughter back from Russia. They tried to use deceivable and dirty ways. They put me under terrible pressure and were forcing me to sing all necessary documents for third party who is British citizen who will travel to Russia and bring my daughter back to the UK in order to give her then under her father's custody to the US. I was unable to cope with the pressure and humiliation any more and turn up to my Russian Embassy for help as I did not have my passport (it was surrended by the UK Police). The UK authorities did not even informed Russian authorities about the case and what situation I am in, that is what they were supposed to do by the International law, but the law was ignored. They did not do it because they knew that they are using prohibitive methods which are agains the Convention of Human Rights. Before I left the UK, I visited my solicitor office in London and I asked once more still being full of hope: "Maybe there is a way out of the situation" as before he assured me that he will be able to defend me on Human Rights grounds, but at this last time he said: "No, there is no chance for you to continue staying in the UK, as soon as they get your daughter back from Russia, they will extradite you back to the US and you will be imprisoned there" So, I left the UK the same evening. It was 20th of December 2006, and almost all flights on that night in Heathrow airport were detained, but our plane to Moscow took off. My solicitor did not leave any hope to me and his last words were: "There is an agreement signed between the USA and the UK for Extradition, but unfortunately, in fact we in the UK stand by the agreemnt when the US demands to extradite someone who is even British citizen, but when the UK demands to extradite someone from the US for procesution and court proceedings in the UK, they would refuse to do that" So, after I left the UK, I breached the baild and the Court gave a warrent for my arrest. I believe there are people who have different opinion regarding the situation of mine. Today I am in my home country and tried hard to find a way of the situation, but I don't know what can I do. I only know there wasn't a fair hearing, I did not have a freedom of expression, no one considered feeling of my little child that she doesn't even know her father and whom they wanted to send back under his custody. I tried to write memebr of parlaimentry John Leech, he contacted the British Home Office on my behalf. I tried to wrote to the Home Office myself, but I did not get a result. One solicitor in London agreed to help me to sort out the case, but then she stopped to contact me, and I don't know why.. Maybe after looking at the case carefully she realised that it is too messy now. When I was still in the UK, I wrote letter to Russian person Roman Abramovich with request to help me to find and pay a good solicitor who can sort out the case, but I have received a phone ring from someone who said to me; Don't even try to write Abramovich again othewise you would find yourself in worse situation" I want to be free to travel, I don't consider a guilty myself, I want to come back to the UK for life or maybe visit, I would love my child to get a British education and I miss my British friends so much.
I pray God to send me someone who can help me in this. I pray for Gary and his family, and I pray for strong help to them. Gary, you are not a criminal, remember that, and believe that there are people around the World who support you and parying for you. I am sure all the trouble will be finished soon and you will win.

When several of the top Aspergers Professors and doctors in the world write to and Tel. Gary's solicitors to say that after seeing him talk on television that they believe that Gary has Aspergers; it is pretty obvious that you are wrong and they are right.
Gary and his family had never asked for a diagnosis as they knew nothing of Aspergers but the world rewnowned Professors, doctors and lecturers on Aspergers and Autism suggested the Diagnosis because they were so convinced by watching Gary that he did indeed have Aspergers.
Many people with Aspergers, even Aspergers womens rights group etc. also telephoned and wrote to Gary's solicitors saying they believed he had Aspergers. The Professors/Doctors/cream of the profession cannot be written off as wrong, no matter how much you would like that to happen.
A very in depth diagnosis was done which included interviews with people from Gary's present and past and even from Ex girlfriends that had no reason whatsoever to help Gary.
When Gary was first arrested one of his ex bosses publicly said the same thing in an interview given by her at the time but we thought she was being silly.
Aspergers doesn't prevent you from being tried in your own country but it could prevent you from being extradited to a country that currently has scant regard for Human Rights and approves of torture being used.

Please also write to the Home Office as Lucy mentioned. In fact, why not write to the PM himself.
The only chance we have now is to convince this government that enough of us feel strongly enough about this that a broad base of people will lose any remaining faith in the Labour party and British politics and not vote for them.
Whatever your views about the effectiveness of democracy in this country and who really runs this world it's not a reason to not try.

As someone diagnosed with Asperger's by none other than professor Baron Cohen himself, I recognised Asperger's in Gary a long time ago.
I've studied everything Autism for 5 years now, I'm the only published female journalist in this country with Asperger's who writes on the subject and my older son was diagnosed with Asperger's. But I'd never dream of 'diagnosing' another person with AS or doubting their diagnosis made by the recognised autism professionals.
For God's sake, will people who are NOT diagnosticians keep their ignorant opinions to themselves?
Including those that express anger at Gary's Asperger's being used as an argument of diminished responsibility. IT IS a valid point to consider but it's not up to you, laymen and trouble-makers, so butt out!

The extradition treaty is ridiculous. For several years Gary lived free, and then he was forced to sign in at the local precinct every night, and he isn't allowed internet access. The U.S. Government is at fault for not using strong passwords, which EVERY computer-literate person is advised to use by any website with logon capabilities. What's more, there was no classified material exposed, no lasting damage done. Several hundred hours community service should suffice. But no, the U.S. wants vengeance. Not justice, but vengeance.

From someone living in the usa, many of us believe he is being used as a scapegoat and it disgusts us. On a day like today, when so many lives were taken in order for the rest of us to lose our rights (in every country), Gary - to me - is a hero trying to save more lives. He has thrust the idea of personal courage and quest for truth back onto the list of being human.
It is an uphill struggle against the current agenda. But we can never quit. Not when we know so much now!

This whole story shows a complete lack of security by the american goverment. Also that the british goverment will bend over backwards and ignore our own law, to stop America getting cross and being childish (punishing the UK for not extradighting people on request). Shame on the people of the UK for not waking up to the fact that our country is being bullied. Sure Gary's a real bad guy - for causing problems and making threats, but given the fact I can't find the actual news, I guess the whole issue is being swept upnder that thick BBC carpet. Shame on BBC for not giving the actual story about freedom and english law being abused.
I mean if some high powered person in America thinks im guitly of a hacking crime, they can say what ever they want agains me, and wont have to provide evidence? Then I'll go to prison in a forign country on false evidence! SCARY / CRAZY?
Anyway, the underlying story is who was actually responsible for the security of those systems. Also what implications has it had for the citezens of the US and UK. What data was accessiblt when conencted to those 'secure' systems?
