It appears that Gary McKinnon's Appeal may now be heard by the House of Lords a little earlier than previously scheduled i.e. starting on Monday 16th June 2008 rather than on the Thursday of that week.
There seems to be quite a bit of interest in this case from various high powered members of the legal profession here in the UK, where the Certified Points of the Appeal (.pdf) include:
Extradition - United States - Coercive plea bargaining - threats - abuse of process - disproportionate sentence - arbitrary denial of repatriation - undertakings as to treatment upon return - enemy combatant
Italy
We are sending you our solidarity. When one of our best secret agents, Nicola Calipari, was "erroneously" killed by Mario Lozano, an American soldier in Baghdad, the US Military justice refused his extradition. Italy is with you, Gary McKinnon.

Wait a sec., Italy. I'm reading the first (huge)book (would "tome" be a better word?) of Lady Thatcher's auto-biography and she wrote something about extraditions that is applicable to Gary as well as fs's observations about "prima facia."
Lady Thatcher wrote that the Irish Republic almost always refused to extradite IRA suspects because they required "prima facia" evidence in order to so.
The US seems pretty consistant in putting in the requirement of "prima facia" evidence in all of its extradition treaties in order to extradite a US citizen to another country.
It seems that Lord Blair (or is it Sir Blair) betrayed the British people and the British nation, when he was Prime Minister and allowed that extradition treaty with the US that does not require "prima facia" evidence for British citizens (Gary, for one) to be extradited. Possibly, Sir or Lord Blair believes in a New World Order that does away with national borders and is led by the US.
The Labour (or is it officially, "New Labour") Party was and obviously, still is, socialist. So is a particular and to remain unnamed, political party on the Island of Ireland, which the Socialist International may have used to derail Lady Thatcher's needed economic and philosophical reforms during "the Troubles." As Lady Thatcher wrote, Britain gave Democratic Socialism, its best chance and it failed. Gary would not be extradited on Lady Thatcher's watch.
One thing for which I'm grateful in this new borderless world, is that my country - the US - won't extradite me without "prima facia" evidence; on the other hand, I'm already there.
Italy and Britain betrayed its citizens by means of their extradition treaties with the US for the common good of the One World Government. I honestly can't understand why the Tories lost power after Lady Thatcher.

@ Honeybear
They never use the "s" word anymore ! They have been funded by foreign billionaires, and have introduced lots of repressive legislation - they have the bureaucracy and mentality of fascists or communists, but without any actual majority support from the public masses.
He is still plain old Anthony Linton Blair.
Technically, it was the blind doubly disgraced former Home Secretary David Blunkett who used the Royal Prerogative (which is wielded by Cabinet inisters of State, rather than actually by Her majesty the Queen) to sign the Extradition Treaty with the USA (which, incredibly, even has US style spellings rather than proper British English ones).
It was , however, a joint NuLabour party decision to rubber stamp (via their large Parliamentary majority at the time) the controversial Extradition Act 2003 into British law, with waiting for the USA to ratify that treaty.
I do not believe that Italy is in the same subservient position as the UK in respect of Extradition to the USA i.e for extraditing people in Italy to the USA.
Technically the Republic of Ireland has a similar treaty to the \UK, but, crucially, they apply a judicial proportionality test before allowing any such extraditions to the USA, which does, of , course, require actually looking at the prima facie evidence before a Judge.
British Judges are not allowed, by the flawed Extradition Act 2003, to do this - they can only check that the "i"'s have been dotted and that the "t"'s have been crossed on the wording of the Extradition Request itself. They have no scope to look at Human Rights issues etc.
There are lots of countries e.g. Japan or the Russian Federation which refuse to extradite their citizens to foreign countries, even for murder or terrorism offences - they try them at home, if there is any actual evidence.

Thanks fg, for the awesome reply. You have my profoundest respect.
Lady Thatcher's book is fantastic, she mentioned the Privy Council. I don't have her monster book in hand right now, but as I recall what she wrote about the Privy Council, maybe Gary can get out of the extradition by means of the Privy Council.
I'm an American and don't want to devote all of my life to the British system of government and politics, but, there's seems to be ways that will allow Gary to have the extradition attempt vacated. What about the Privy Council????
Thanks.

my thoughts are with you gary. i also know ufo's are real, and if this sounds crazy, just wait 4 and a half years. good luck everyone.

Wishing you all the best Gary. The American administration is the nazi germany of our generation. To the Lords and Ladies due to attend the hearing I say this to you: 'The only way McKinnon is going to get a fair trial is in this country. If they've gone to the trouble to extradite him, they're just going to lock him up and throw away the key.' FREE MCKINNON!

The American administration is more than like Nazi Germany. The National Security Act that was passed in 1947 voided the U.S. Constitution. It was passed at the same time as the C.I.A. Operation Paperclip which imported around 500 Nazi scientists.
America under the current President, has taken away all of the rights of U.S. citizens, except one - habaeus corpus - when a particular American is designated to be an Unlawful Enemy Combatant, by the President or someone who the President authorizes to do so. Gary has no rights under U.S. law, not even the right to have the U.S. live up to its agreements with the British government.
America turning into a police state was due directly to the Nazis brought to America in Operation Paperclip.
But, the American establishment was open to Nazi philosophy. First, one of the current President's ancestors supported the Nazis even after the beginning of World War II. The F.B.I. had to shut him down.
But, even more, the U.S. had an official policy of genocide from the beginning of its existance, toward the Native Americans. Check out

After reading it, you'll probably agree that the Texas cowboys in the White House have decided that it's now the Arabs' turn. It's one long slaughter.

fg,
Great Britain is under attack. The information on Gary's site's home-page about the House of Lords and the Law Lords helped me to realize this.
Even at the close of WWII, Britain was a super-power. However, at that time, the U.S. (not America, other people in the Americas - South, North, and Central - are also Americans) was competing with Great Britain to become the World's leader. Even Lady Thatcher, in her book, wrote that Britain had to accept that the free world is led by the U.S. Yet, she also supports the nation-state within the New World Order.
But, the people who want a New World Order, want to do away with the nation-state. So, Britain is a target. Being a countre-balance to the U.S. on the international scene, for example, its more rational approach to the environment and cluster-bombs, is a threat to the Neo-conservatives and Western Fundamentalists.
That threat is why the U.S. is using Gary to attack Britain's sovereignty. It's also why Spain mocked Great Britain by prosecuting a British citizen on the second charge instead of the first as you posted on this site's home page.
Do you think that any other country, even other countries that are under attack by the N.W.O. such as Russia, will stand up and defend British sovereignty in order to defend there nation-state? No.
As you can see below. Britain is once again in a financial crisis. Yet, the experts, even in Nu Labor, know what should be done.
Fg, your post on this site's home page, giving information about the Law Lords is a giant step in the right direction. The more information that you provide about the British system as it relates to Gary's predicament, the more all of us will appreciate that Great Britain is under attack by the N.W.O. in an attempt to make the U.S. the undisputed champion of the World.
If we understand and the Conservative (Tory) Party and Lady Thatcher are revealed to have had the answers all along, so be it. Britons need to know. Mr. Gordon Brown is the Prime Minister who is seeing to Gary being thrown to the wolves.
=================================================
"GORDON Brown's reputation took another battering yesterday as global economic experts strongly criticised him for failing to plan for a downturn during his decade as chancellor."
"Mr Brown, who ran the Treasury from 1997 before becoming Prime Minister nearly a year ago"...
"Philip Hammond, the Tory shadow chief secretary to the Treasury, said: "This worrying report confirms what the Conservative Party has been saying all along – that Gordon Brown failed to fix the roof when the sun was shining. He borrowed in a boom, leaving us with the largest budget deficit of any industrial economy. Now we are all paying the price for his economic mismanagement, with Britain less well prepared than any of its neighbours to weather an economic slowdown."
"Vince Cable, the Liberal Democrats' Treasury spokesman, said: "This is truly awful news for the government. It confirms all the worst fears about a deteriorating economy, and the lack of any freedom of manoeuvre due to lax control of government spending on Gordon Brown's watch."

"A British businessman who has served 21 years in jail in Florida has lost his final plea for mercy - meaning he faces the rest of his life behind bars."
Check out today's latest insanity involving a British citizen in the U.S. legal system at
http://news.bbc.co.uk/2/hi/uk_news/7439007.stm
"This followed a review of the case documents by the UK Foreign Office which concluded the defence team had shown that there was “prima facie evidence of a miscarriage of justice"
Extraordinary support
"Former Conservative minister Peter Bottomley listed the high-level political support for Maharaj - including the foreign secretary and former attorney generals Lord Goldsmith and Lord Lyell."
"The MP said it was extraordinary to have the support of two ex-attorney generals - who hardly ever intervened in such cases."
Anytime Lord Goldsmith joins the fray -- Watch Out.
This BBC news article about the British government objecting to the treatment of one of its citizens by the U.S. legal system can only mean that it will drop Gary's extradition. No matter what the U.K. has or has not done up till now, in Gary's case, its response to the treatment of one of its citizens in the state of Florida can only mean that it has reapprased its position in Gary's case.
His mum and dad, Jan and Jay..., should have a look at today's news.

Extremely sad about the business man in Florida. He'll now be left to die in a US prison.
I wish they would reapprased their position in Gary's case. Hopefully the Lords will come to the right decision Re-Gary.

Let's prepare for the worst. If Gary ends up in a U.S. prison, what can we do to make his life more tolerable. All of us who read the posts on this web-site should each find out what are his rights in a U.S. prison. For example, what types of books can we send him and how many and under what circumstances. Also, there're rules concerning correspondence. A friend of mine was in different jails around Portland, Oregon a few years ago. The correspondence that I sent her could not contain any staples, holding the pages together.
I doubt, under current circumstances, that Gary will be extradited. But, just in case, maybe fg can find out where he'll be held during the trial and what the rules are for corresponding with him and sending him books and ALL other things. There should be a steady supply of everything, being sent to him that is allowed. Many people will be willing to mail him things that are allowed, that will pick up his spirits. Spending $10.00 every now and then on stuff for Gary will not hurt.
There's also no reason to ignore the plight of that other British citizen, Maharaj, in Florida, who will be spending the rest of his life in prison for a crime that he didn't commit. Finding out how to provide material support for him will also help us help Gary in a worst case scenario.
My appologies to the Labour party - Lord Goldsmith is a Labour lawyer. Nu Labor can't be all bad"

Free the GazMan!! America should be thanking Gary for finding what any IT nerd would consider grand canyon size holes in their firewalls! He could've destroyed their network from the inside if he wanted to, but he didnt... This in its self proves he is no threat to America's National Security!

What's the betting the next thing the Americans will want will be demanding that Gary be sent to Guantanomo Bay - to serve out his term for not 'admitting the truth' - the truth as the Americans see it.
Keep going Gary we expats living in Australia also have a multitude of problems - called - challenging R.Murdoch.
He is an American isn't he?????????????

Thought I should point out that The Register didn't point out that Gary is facing a sentence of Ten Years per count, amounting to a Sixty year sentence and not ten years as stated by the Register.
Also a bit worrying that Gary's Law LOrds appeal was brought forward by several days and was held on the same day as Bush's was LOndon and was virtually right next door to the House of Lrds at one point.
The fact that Bush, the EX boss and sidekick of Ed Gibson and Co. (the very people that allegedly threatened Gary in the US Embassy in London) is having dinner in London with the elite of the UK when Gary's appeal is taking place (an appeal that will set a precedent across Europe), is pretty worrying.
We can only hope that the Law Lords won't be swayed by the presence of the soon to be Ex President.
