@ Ellen - unfortunately the Extradition Act 2003 was rubber stamped into law, before the Treaty was ratified by the USA, so it is definitely in force here in the UK.

The Magna Carta of 1215 was revoked by Papal Bull, a few months after it was sealed (not signed) in Runneymede, essentially as fast as a messenger could travel from England to Rome and back via medieval transport.

The rule of law must be upheld. Gary must stand trial in a US court of law. After all if an American was to conduct a criminal offense agaisnt England he/she would be handed over to British Justice.

Nobody has ever been Extradited to the United Kingdom to face Computer Misuse charges.

Currently the 6 month maximum penalty under the Computer Misuse Act 1990, precludes Section 1 offences of unauthorised access ("hacking') from being serious enough (penalty of 1 year or more in prison) to be eligible for Extradition.

That will change some time in April, when the penalty goes up to 2 years in prison maximum, when the amendments to CMA brought in by the Police and Justice Act 2006 which are currently on the Statute book, will probably brought into force by Order.

Even then, the situation of such a hypothetical US defendant would not be the same as that which Gary McKinnon faces. If someone in the USA did exactly what Gary is accused of, remotely over the internet, in the UK, then the UK authorities would have to to show prima facie evidence to a US Court, which has not happened in Gary's case, due to the dreadful Extradition Act 2003.

A hypothetical US defendant would, even if extradited, and found guilty, never be facing 70 years in prison - the most notorious multiple murder or espionage cases have not exceeded 45 years in prison

At such a hearing, the vastly exaggerated claims of actual financial damage would be be challenged by the defence lawyers, and probably thrown out of court.

There is no reason why Gary McKinnon could not have been tried fairly and proportionately, in the UK, under the Computer Misuse Act, which has been applied to computer hacking cases in the USA before, and which has world wide scope.

Now for something very important for Gary. If British law requires British citizens to contact their local Special Branch office whenever they have contact with someone who is in the military or intelligence community of a foreign country, then if Gary did NOT report his contact with the female N.A.S.A. lab technician in building eight of that Florida, U.S.A., N.A.S.A. base, Gary could be charged with a very serios crime under British national security laws.

In that case, the extradition would be dropped and Gary could plead no-contest to the crime of not reporting, if he'd receive no jail time and no fines. Twenty years of community service would be an honourable sentence and would take the American ("Grays") and British governments off the hook of this embarrassing episode.

One more thing. The list of Americans Space Officers and the huge N.A.S.A. photo of a U.F.O. orbiting Earth, may have been legitimate. The anti-"Grays" underground in the U.S. military, may have fed it to Gary in order to fight the "Grays" take over of America and eventually the world.

The Zeta Reticulians engineered the "Grays." That means they're different than them. They may really be Sponge Bob without legs and arms.

Almost every country has such foreign military / foreign intelligence contact reporting rules, but only for the people who are actually working for the Government on top secret projects or who are stationed in embassies etc. overseas. It is not illegal for normal UK citizens to do so, even supposing that they know exactly who they are in contact with.

To quote the Home Secretary Jacqui Smith recently on 21st February 2008:

It is illegal for foreign intelligence agencies to operate in this country.

You do not have to invent any new crimes for Gary to be charged with, he could already have been charged here in the UK under the Computer Misuse Act 1990 at any time since 2002, which would have taken precedence over any foreign extradition request.

If convicted or acquitted, he would not be liable for extradition to face charges, on the same facts.

We can't ask Gary and probably, neither can you. But, could you please give us your opinion?

Did Gary ever publicize the names of the Non-terrestrial Officers? It may be important. During the J. Edgar Hoover leadership of the F.B.I., there was a Mormon cabal in the upper levels of the F.B.I. That was very valuable information to other intelligence services, if not international criminals operating in the U.S. The names of the Non-terrestrial Officers could give us a clue about a certain sector of American society that is working with the E.B.E. ("Gray").

Also, if the list is fake, the names would give valuable information about the people who created this piece of disinformation. Psycho-linguistics.

The names of the ships would also provide valuable information about the people who gave the ships their names including part of their intentions. The names could also be compared to the names of other U.S. military ships and thereby provide valuable information about official U.S. military policies and maybe a separate chain of command.

I was thinking - not one of my strenths - and realized that the reason for Gary believing that the names of the Non-terrestrial Officers differed from the names on the many other lists of U.S. military officers that Gary found, is that the Non-terrestrial Officers are officers in corporations, not the U.S. military. That may be one reason why the U.S. dropped the charges against Gary that involved private companies - defense contractors. The U.S. government is keen on out-sourcing - Haliburton and Blackwater are two examples of what can go wrong with privitization.

Also, according to some U.F.O. researchers, U.S. military personell are put on "detached service" and then are employed by defense contractors in order that the U.S. government can avoid accountability. Go to Area 57 or Dulce, New Mexico and you'll be turned back by private security.

Gary's list may be of a defense contractor or group of contractors.

The ship transfer list could refer to companies using the made up names of phoney ships. Also, the ship names could refer to departments in a defense contractor or a group of defense contractors at some classified base. Even so, the names of the ships would give us a lot of information about the people who made up the names. Is there a particular group of Americans who are the principle leaders in government U.F.O. coverup; Americans who share certain traits, such as religion, who's choice of ship names would give them away? The Mormons who had and may still have a faction in the top leadership of the F.B.I., had to have acted in a certain (a pattern) way in accordance with their belief system that would have or is giving us clues about their identity.

After Gary has told British security services all that he learned, couldn't he give us at least the list of ship transfers?

A recent book about the Barney and Betty Hill abduction states that Zeta Reticuli is a planet. The author may have been refering to planet Serpo.

The above two sites prove that Gary did not make up his claims to have seen a list of Non-terrestrial Officers and inter-fleet transfers between space ships, that he compared to the dozens of other lists of names of U.S. military personel and ships that did not match those first set of lists.

As a licensed practicing Skinnerian behaviouralist (animals), specializing in learning (and mood altering drugs), I know that even though Gary was under the influence of both marijuana and alcohol when he saw those lists, he is able to recall the names of the active duty U.S. Military personel and ships, because he compared them to the other lists that he uncovered. That required intense intellectual activity which moved the names into his long-term memory. If he had just looked at the names and then moved on, they would not have transfered to his long-term memory, unless he had the same training as espionage agents.

hacker targets. If Garry could get in then
who else (not so nice people and spies) could get
up to? There are many hacker legends of hackers getting
the 'unattainable prize' but its often up to the viewer
to make their own conclusion. Garry is a white hat hacker as he could easily sold his secrets like a black
hat would.....but he only wanted knowledge on a rather
pressing subject in human history and not much else.

Garry's case has been going since 2000 odd with no end

Recent condemnation of the Chinese governments decision to execute Akmal Shaikh on the basis of mental disorder/instability serves to highlight the double standards of the UK government. Seems that it's OK to extradite a UK citizen with a PROVEN mental condition while demanding the repatriation of a convicted drug smuggler with a SUSPECTED mental condition.

People with Aspergers need a person to look out for them. These people (carers) are paid benefits by the government, because this is a recognised medical condition. If Gary is extradited will his carer go with him as well? If not then he surely can't be extradited,because his mental state will not be protected. The USA won't care whether he's got Aspergers or diarrhoea. All they're interested in is getting they're hands on Gary, and all Mr Brown is interested in is being a good boy and doing as he's asked. Why doesn't Mr Brown or Alan Johnson give him a lethal injection now, after all, his life won't be worth living if he's extradited. What a country we live in, if we can't protect our most vulnerable people, from not only other countries, but our own politions as well.
